The main hypothesis of the article is that the constitutions of both countries provide for various mechanisms in order to exercise parliamentary oversight, the purpose of which is, in principle, to limit and control the powers of the judiciary and the executive. The parliament, as a democratic institution, has several functions. According to the Constitution of the Islamic Republic of Iran, the parliament has important legislative and oversight functions that have affected the executive and judiciary. In the Republic of Azerbaijan, due to electoral challenges and strong segregation, the parliament has not been able to create a popular and global image to the desired standards. The results of the research show that the structure of the parliament in Azerbaijan has little intellectual and spiritual support in the society and compared to the supervision in the legislature of the Islamic Republic of Iran, due to the weak support of the people, MPs are less inclined to answer to the people. As a result, the power of the representatives is more in line with their interests, and the oversight of the pillars of the government has weak popular support. The present research has been done by descriptive-analytical method and using libraries and documents and using the constitution as the main sources.}, keywords = {Parliamentary oversight,Constitution,Judiciary,Republic of Azerbaijan,Islamic Republic of Iran}, title_fa = {بررسی تطبیقی جایگاه نظارتی مجلس در قانون اساسی جمهوری اسلامی ایران و جمهوری آذربایجان}, abstract_fa = {سؤال اصلی مقاله این است که، جایگاه نظارتی مجلس در قانون اساسی ج.ا.ایران و جمهوری آذربایجان چگونه قابل تبیین است و هدف از این نظارت چیست؟ فرضیه اصلی مقاله این است در قانون اساسی هر دو کشور، سازکارهای مختلفی در راستای تحقق نظارت مجلس پیش بینی شده است که هدف از آن، اصولاً تحدید و کنترل اختیارات قوه قضاییه و مجریه است. مجلس به عنوان نهاد مردم سالار، از وظایف متعددی برخوردار است. برابر قانون اساسی ج.ا.ایران، مجلس کارکردهای مهم قانونگذاری و نظارت را بر عهده دارد که قوای مجریه و قضاییه را تحت تاثیر قرار داده است. در جمهوری آذربایجان، به دلیل چالش‌های انتخاباتی و تفکیک قوی، مجلس نتوانسته است، وجهه‌ای مردمی و جهانی در حد استانداردهای مطلوب برای خود ایجاد کند. نتایج تحقیق نشان می‌دهد که، ساختار تشکیل مجلس در آذریایجان، از حمایت‌های فکری و معنوی کمی در جامعه بر خوردار است و در مقایسه با نظارت در قوه مقننه ج.ا.ایران، به دلیل ضعف حمایت مردم، نمایندگان تمایل کمتری برای جوابگویی به مردم داشته و نتیجتاً قدرت نمایندگان بیشتر در راستای منافع خود بوده و نظارت بر ارکان دولت، پشتوانه مردمی ضعیفی دارند. پژوهش حاضر با روش توصیفی تحلیلی و با استفاده از کتابخانه‌ای و اسنادی و بهره گیری از قانون اساسی به عنوان منابع اصلی انجام شده است.}, keywords_fa = {نظارت مجلس,قانون اساسی,قوه قضائیه,جمهوری آذربایجان,جمهوری اسلامی ایران}, url = {https://www.rahyaftjournal.ir/article_123027.html}, eprint = {https://www.rahyaftjournal.ir/article_123027_405db5f8dbcdfa12946df7a7f7648be1.pdf} }
