After political jurisprudence was used by Imam Khomeini as the basis for the establishment of the Islamic government and led to the formation of the Islamic Republic, the dimensions of jurisprudence became very wide and not limited to political spheres. The question that the present study raises is: In what ways can political jurisprudence in the thought of Imam Khomeini (ra) advance the future interests of the Islamic system based on the public interest? The hypothesis of the article is: Political jurisprudence in the thought of Imam Khomeini (ra) is not conservative and, taking into account social interests, lays down new rules that are proposed in the interests of Islamic society. The method of the present article is descriptive-analytical which has been compiled by collecting data through documentary sources and libraries. فقه سیاسی به عنوان منبع صدور احکام و بر مبنای اجتهاد پویا، نقش مؤثری در تأسیس نظام اسلامی در دوره معاصر و همچنین راهکارهای تداوم آن در اندیشه امام خمینی (ره) ایفا می‌نماید. پس از اینکه فقه سیاسی توسط امام خمینی (ره) به عنوان مبنایی برای تأسیس حکومت اسلامی به کار گرفته شد و منجر به شکل­گیری جمهوری اسلامی گردید، ابعاد فقه بسیار گسترده شد و تنها به حوزه­های سیاسی محدود نماند. سؤالی که پژوهش حاضر مطرح می­کند این است: فقه سیاسی در اندیشه امام خمینی (ره) از چه راه‌هایی می‌تواند مصالح آینده نظام اسلامی را بر مبنای مصلحت عموم جامعه به پیش ببرد؟ فرضیه نوشتار این است: فقه سیاسی در اندیشه امام خمینی (ره)، محافظه­گرا نیست و با در نظر گرفتن مصالح اجتماعی، احکام جدیدی را وضع می­کند که در راستای مصالح جامعه اسلامی مطرح می­شوند. روش مقاله حاضر توصیفی-تحلیلی است که با گردآوری داده­ها از طریق منابع اسنادی و کتابخانه­ای تدوین شده است. https://www.rahyaftjournal.ir/article_110366_00b211ac8ce7d18f1967e8d1b9f61e95.pdf
