Accordingly, the research question is: Are government decrees an obstacle to the realization of democracy or are they manifestations of religious democracy? The research hypothesis is as follows: The highest political authority in the country has special powers, according to the principles and goals of the rule of law, which eliminates tyranny and authoritarianism and the realization of social justice, is no different from religious democracy. One of the most important results of the present study is: the Constitution of the Islamic Republic of Iran, by specifying the powers of officials and equating them with other people by providing tools to monitor their performance, has accepted this principle, on the other hand, according to Islamic law, the ruler Islami has the right to make the necessary decisions in accordance with the public interest to meet the needs of the people. A government decree is therefore a way of defending the public interest based on the public interest, which may take on different dimensions depending on the developments of the time. The method used in this research is descriptive-analytical. هدف پژوهش حاضر بررسی و نسبت­سنجی احکام حکومتی با مردمسالاری دینی است. بر این اساس، سؤال پژوهش این است: آیا احکام حکومتی مانعی برای تحقق مردمسالاری به شمار می­روند و یا اینکه جلوه­گر مردمسالاری دینی هستند؟ فرضیه پژوهش بدین ترتیب است: برخورداری بالاترین مقام سیاسی کشور از اختیارات ویژه، با توجه به مبانی و اهداف اصل حاکمیت قانون که محو استبداد و خودکامگی و تحقق عدالت اجتماعی است، تغایری با مردمسالاری دینی ندارد. از مهم­ترین نتایج پژوهش حاضر این است: قانون اساسی ج.ا.ایران با مشخص نمودن اختیارات مسئولین و برابر شمردن آن‌ها با سایر مردم با پیش‌بینی ابزارهای نظارتی بر عملکرد آن‌ها این اصل را پذیرفته است، از طرفی به موجب شرع اسلام، حاکم اسلامی حق دارد مطابق مصالح عمومی برای پاسخگویی به نیازهای مردم، تصمیمات لازم را اتخاذ نماید. حکم حکومتی بر این اساس راهی برای دفاع از منافع عمومی بر مبنای مصلحت عامه مردم است که برحسب تحولات زمانه ممکن است ابعاد مختلفی نیز پیدا کند. روش مورد استفاده در این پژوهش توصیفی-تحلیلی است. https://www.rahyaftjournal.ir/article_123020_47481574aae113c38b505d1dfdcad780.pdf
